Air Concierge, Inc. (“Air Concierge,” “we,” “us,” “our,” or “Airconcierge.net”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information about consumers (including our customers, website visitors, and users of our services) and job applicants in our roles as a “business” under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together, “CCPA” or the “Act”). This Policy applies to personal information we process through our Airconcierge.net, manageairconcierge.net, and airconciergevacationhomes.com websites (together the “Sites”), services, and the Air Concierge mobile application (collectively, the “Service”).

By using the Service, you agree that you have read, understand, and agree to all terms and conditions stated herein, including our Terms of Service available at www.airconcierge.net/tos, which is incorporated herein by reference. You are giving Air Concierge permission to use and store such information consistent with this Privacy Policy and our Terms of Service. A user of the Service is hereinafter referred to as a “User,” or collectively, the “Users.”

We provide this Policy to inform you about our privacy practices and your rights under the Act. This Policy was last updated on the effective date above and will be reviewed and updated at least annually to ensure ongoing compliance. Our Sites contain links to other websites; for information on those sites, please review their privacy policies (see Section 9 of our Terms of Service for more details).

1. Personal Information We Collect

We collect personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“personal information”). Personal information is collected only if you voluntarily choose to share it with us. You may browse the Sites without disclosing any personal information. However, to take advantage of particular opportunities provided through the Service (e.g., registering an account, signing up for newsletters, completing forms for optional programs, surveys, contests, or other entries, or using the mobile application), we may require that you furnish personal information.

In the preceding 12 months, we have collected the following categories of personal information (as defined in the Act). We do not collect all categories and only collect what is necessary to provide our luxury air travel concierge services, including booking flights, managing itineraries, and personalized travel assistance.

IDENTIFIERS

Identifiers: Examples include name, postal address, unique personal identifier, online identifier, IP address, email address, or other similar identifiers. Collected: Yes (e.g., name, address, phone number, email during registration or bookings).

•  California Resident Information under Cal. Civ. Code § 1798.83: Examples include name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state ID number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Collected: Yes (limited to name, address, phone, email, and payment details like billing name, address, and credit card number for bookings).

•  Protected Classification Characteristics: Examples include age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, and gender expression), sexual orientation, veteran or military status. Collected: No.

•  Commercial Information: Examples include records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. Collected: Yes (e.g., travel bookings, preferences, shopping basket items).

•  Biometric Information: Examples include genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or biometric information, such as fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. Collected: No.

•  Internet or Other Similar Network Activity: Examples include browsing or search history, information on a consumer’s interaction with a website, application, or advertisement. Collected: Yes (e.g., site interactions, web navigational data).

•  Geolocation Data: Examples include physical location or movements, precise or approximate. Collected: Yes (travel-related locations).

•  Sensory Data: Examples include audio, electronic, visual, thermal, olfactory, or similar information. Collected: No.

•  Professional or Employment-Related Information: Examples include current or past job history or performance evaluations (not applicable to consumers). Collected: Yes (for employees/job applicants: name, address, job title, location, compensation, identification number, employment history, employment agreements).

•  Non-Public Education Information: Examples include education records directly related to a student maintained by an educational institution or agency. Collected: No.

•  Inferences Drawn from Other Personal Information: Examples include profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. Collected: Yes (e.g., travel preferences from market research).

We also collect anonymous or aggregated data about Service use, which is not linked to you personally. For employee data, see Section 4 below.

Sources of Personal Information

  • Directly from you: When you provide information via our Sites, app, phone, email, or in person (e.g., booking requests, contact forms, account registration).

  • Automatically: Through cookies, web beacons, pixel tags, clear GIFs, Flash cookies (or local shared objects), mobile identifiers, and tracking URLs on our Sites and app; device identifiers; IP addresses (to monitor regions and prevent fraud); browser-transmitted data like visit times and pages viewed.

  • From third parties: Travel partners, payment processors, service providers (e.g., airlines, hotels), analytics partners (e.g., Google Analytics), advertisers (e.g., Google, Facebook, Microsoft, Criteo), and publicly available sources. Third-party social plugins (e.g., Facebook Like Button) may send viewing data to those providers.

Cookies and Similar Technologies: We use session cookies (expire on browser close) for features like session info and traffic routing, and persistent cookies for login saving, preferences, and promotions tracking. Third-party advertisers may place/read cookies for targeted ads. We use web beacons/pixels in emails and ads to track opens, clicks, and campaign success. For choices: Adjust browser settings to reject cookies (may limit functionality); opt out via Network Advertising Initiative, Digital Advertising Alliance, Google Ads Settings, or Google Analytics Opt-Out Browser. We do not respond to browser Do Not Track signals but provide these opt-out links.

Purposes for Collecting and Using Personal Information

We use personal information for:

  • Providing and improving our concierge services (e.g., bookings, personalized recommendations, enabling Platform access).

  • Processing payments, billing, identification, authentication, and fraud prevention.

  • Communicating with you (e.g., confirmations, updates, administrative notices, texts/calls for Service—opt out at opt-out-info@airconcierge.net or see Terms Section 8).

  • Marketing and advertising (e.g., tailored ads via cookies, emails about events/promotions—opt out via profile notifications or info@airconcierge.net).

  • Internal analytics, market research (aggregate, non-revealing), troubleshooting, and compliance.

  • Legal obligations (e.g., tax reporting, enforcing Terms).

We do not “sell” or “share” personal information as defined under the Act, but if we do in the future, we will update this Policy and provide opt-out mechanisms. Financial information is used solely as authorized by you.

Disclosures are limited; we require recipients to agree in writing to confidentiality and Act compliance. We do not disclose for third-party marketing without consent and hold no responsibility for affiliates’ policies (you agree to hold us harmless).

3. Your Rights Under the Act

As a California resident, you have rights regarding your personal information (applies to consumers and job applicants, subject to exceptions like transaction completion).

  • Right to Know/Access: Request categories/sources/purposes/recipients of collected/disclosed/sold info in past 12 months.

  • Right to Delete: Request deletion, subject to exceptions.

  • Right to Correct: Request correction of inaccuracies.

  • Right to Opt-Out of Sale or Sharing: Opt out (we currently do not; honor Global Privacy Control via Sites).

  • Right to Limit Use of Sensitive Personal Information: Limit to necessary purposes (we collect minimally for travel).

  • Right to Non-Discrimination: No retaliation for exercising rights.

How to Exercise Your Rights

  • Verification: Match on-file info (e.g., email confirmation); additional proof for sensitive.

  • Response: Within 45 days (extendable 45 days); free unless excessive.

  • Opt-Out Signals: Sites recognize GPC; for ads, use NAI/DAA links above.

  • Edit Profile: Log in > My Account to update (some sensitive data like age requires info@airconcierge.net contact; under-18s not allowed).

  • Appeals: Email info@airconcierge.net with “Appeal” subject.

For communications opt-out: Profile > Notifications > Email alerts; or info@airconcierge.net for unsolicited emails.

4. Additional Information for Job Applicants and Employees

For job applicants and employees, we collect employment-related information (e.g., resume, references, background checks, equal opportunity data voluntarily provided; name, address, job title, compensation, history, agreements). Sources: You, references, third-party services.

Purposes: Application evaluation, background checks, employment laws, onboarding, administrative tasks, policy investigations.

Disclosures: To recruiters, background firms under strict contracts.

Rights apply fully; no sale/sharing. Contact hr@airconcierge.net for application questions. Only authorized staff access full info.

5. Retention and Security

We retain personal information as long as necessary for purposes (e.g., indefinite for database integrity, 7 years for financials) or required by law. Delete on request (unless law requires retention) via delete@airconcierge.net.

Security: Password-protected accounts (don’t share; sign out on shared devices). Backups, public key encryption, firewalls, access controls. Sensitive data (e.g., credit cards) encrypted in transit. Dedicated staff review security; employees trained. No system is 100% secure—we disclaim liability for unauthorized access and you transmit at your risk (hold us harmless per Terms).

6. Children’s Privacy

Our Service is not directed to children under 16 (or 18 for registration), and we do not knowingly collect their personal information.

7. Changes to This Policy

We may update this Policy for practices or law changes. We will notify via email or Site posting at least 15 days before (except minor updates) and encourage periodic review. Not liable for notification failure. Inquire at info@airconcierge.net if unclear.

8. International Users

The Service is U.S.-based (headquartered in U.S.). Your information may be processed/transferred to U.S. and subject to U.S. law, which may differ from your country’s. By using the Service or providing info, you consent to this collection, transfer, storage, and processing. We take reasonable steps for security per this Policy.

Personal Information. Airconcierge.net and manageairconcierge.net and airconciergevacationhomes.com collects personal information only if you voluntarily choose to share such information with Airconcierge.net. You may browse the Site without disclosing any personal information. However, in order for you to take advantage of particular opportunities provided through the Service, we may require that you furnish personal information. When you register your account, sign up for newsletters, complete forms for optional programs, surveys, contests and other entries, and through communications transmitted through Airconcierge.net, applications and your use of the Airconcierge mobile application, we collect information including your name, address, phone number and email address. Anonymous or Aggregated Data. Airconcierge.net collects and stores certain data about the use of the Service on an aggregate and/or anonymous basis. Airconcierge.net does not link this information to anything personally identifiable to you.

Cookies and Other Technologies (“Cookie Policy”). When you visit websites on the Internet, your browser may automatically transmit information to the websites you visit throughout every visit. Like many websites, we may use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We may utilize persistent cookies that only Airconcierge.net can read and use to save your login information for future logins to the Service, to assist in processing items in your shopping basket, to hold session information, and to track user preferences. We are committed to providing you with meaningful choices about the information collected on the Air Concierge Platform for third party purposes, which is why we provide in our Cookie Policy the Network Advertising Initiatives Consumer Opt-out link, Digital Advertising Alliances Consumer Opt-Out Link, and Google Analytics opt out link. However, we do not recognize or respond to browser-initiated Do Not Track signals.

California Privacy Notices and Rights

If you are a California resident, you have certain rights with respect to your personal information.

i. Notice at Collection and Notice of Financial Incentives. At or before the time of collection, you have a right to receive notice of our practices, including the categories of personal information and sensitive personal information to be collected, the purposes for which such information is collected or used, whether such information is "sold or shared" as defined under California law and how long such information is retained. ii. Rights to Know, Correction and Deletion. You have a right to request that we disclose to you the personal information we have collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal information. Note that we have provided much of this information in this Privacy Policy. You also have rights to request that we correct inaccurate personal information and that we delete personal information under certain circumstances, subject to a number of exceptions. Under the CCPA, these rights are subject to certain exceptions: for example, we may need to retain your personal information to complete a transaction or other action you have requested. If your request is subject to one of these exceptions, we may deny your request.

IP Address. When you visit and interact with the Site, Airconcierge.net and/or third parties with whom Airconcierge.net has contracted to provide services to Airconcierge.net may collect your Internet Protocol Address (“IP Address”), which is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use IP Addresses to monitor the regions from which Users navigate the Site and for fraud prevention purposes.

The Company also collects and uses personal data regarding its employees (“Employee Data”), which may include: name, address, job title and other job information, location, compensation information, identification number, employment history, and a copy of employment agreements.

We may also require you to provide us with your financial information, including billing name, address and credit card number (“Financial Information”).

Only authorized Airconcierge.net staff have access to your Personal Information in its entirety. Other staff may have access to portions of this information if it pertains to their job duties.

Airconcierge.net's Use of Personal Information

Airconcierge.net uses Personal Information for the following general purposes:

to provide our products and the Service,

for billing, identification and authentication, and fraud prevention,

to analyze Site usage and improve our products and the Service,

to contact you and deliver administrative notices and communications relevant to your use our products and services,

for internal market research, troubleshooting problems, and detecting and protecting against error, fraud or other criminal activity,

Although we ensure that our third party agents (“Agents”) receiving your information are bound by privacy restrictions at least as restrictive as those set forth in this policy, Airconcierge.net is not responsible for any issues that may arise regarding the Privacy Policies of any of its affiliates or advertiser. By using this website, you do hereby agree to hold Airconcierge.net harmless from any claims and/or damages that may arise from the actions of any of its affiliates and/or advertisers.

Two things drive Airconcierge.net's decisions regarding the use of information collected from Users: 1) improving user experience by offering personalized services, content and advertising, and 2) market research.

Ads are a standard part of user experience on the Internet, and Airconcierge.net believes that targeted advertising enhances this experience. Airconcierge.net may use Cookies and other Technologies and Personal Information to place ads where they believe interested parties will see them.

In addition to banner ads, Airconcierge.net may advertise products, companies and events that we think might interest you through the email address you provide.

Airconcierge.net may analyze Personal Information and Web Navigational Data based on your interests and may use the analysis from this information in a way that doesn’t reveal a User’s personal information (“Market Research”) in order to:

Increase the likelihood that a group's experience with the Service is relevant to its interests as a whole

Airconcierge.net uses data at the individual level to sell products and services to Users who express an interest in these products and services, through a poll for example, or to Users who can be presumed to have an interest based on results from our Market Research.

Airconcierge.net may use your cell phone number to call or text you in order to provide the Service. If you would like more information about our policy, or to opt out, please review Section 8 of our Terms of Service, or email opt-out-text@airconcierge.net.

Employee Data is only used for the for the purposes of facilitating the performance of certain administrative tasks and functions relating to general employment and for processing and investigating reports under the Company’s codes and policies ( “Employee Data Purposes”).

We use Financial Information solely as authorized by you in accordance with the Service.

Choice/Opt-Out

You may opt-out of receiving communications from us and our partners, remove your information from our database, and choose to not receive future communications unrelated to the Service.

During registration you choose whether to receive correspondence from either Airconcierge.net or its partners and whether you want to participate in a variety of Airconcierge.net programs. This information remains on your Profile where you can, at any point, easily edit it to indicate that you have changed your mind. After logging on, click on your profile on the top right of any page, then select “Notifications.” You may then click on "email alerts," and make your selections. If you purchase anything through Airconcierge.net, we may occasionally contact you with information about special events, sales, activities, promotions, contests, submission opportunities and programs. You always have the option to ask Airconcierge.net not to contact you with this information again.

If you receive unsolicited email from a Airconcierge.net domain, please contact us at info@airconcierge.net.

Airconcierge.net's information retention policy

To preserve the integrity of our databases, we may retain information submitted by Users for an indefinite length of time. If required by law, we will delete Personal Information by erasing it from our database. We will also respond to User requests to delete or correct account or Personal Information, which you can do by contacting Airconcierge at delete@airconcierge.net.

Airconcierge.net security of collected information

Your Airconcierge.net account is password-protected so that only you and authorized Airconcierge.net staff have access to your account information. In order to maintain this protection, do not give your password to anyone. If someone who represents to you they are Airconcierge.net staff and asks for any personal account information, including password, check their URL. If it doesn't say they are info@airconcierge.net, they aren’t. Also, if you share a computer, you should sign out of your Airconcierge.net account and close the browser window before someone else logs on. This will help protect your information entered on public terminals from disclosure to third parties.

Airconcierge.net makes every effort to ensure that your information is secure on its system by backing up data in separate back up drives and uses public key access encryption and firewalls on both our main and backup servers. We also employ and customer record managers to protect against loss, misuse and alteration of the information under our control. Extremely sensitive information, like credit card numbers, is always transmitted in encrypted form. Only certain authorized Airconcierge.net staff can access Personal Information, and then only if it is relevant to their job duties. Airconcierge.net has staff dedicated to maintaining this Privacy Policy and other privacy initiatives, periodically reviewing security and making sure that every Airconcierge.net employee is aware of our security practices. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Airconcierge.net cannot guarantee the security of any information you transmit to us, and you do so at your own risk. While Airconcierge.net will use commercially reasonable efforts to ensure the security of all credit card and all other personal information, we expressly disclaim any liability for any unauthorized access to or use of our secure servers and/or any and all personal and/or financial information stored therein, and you agree to hold Airconcierge.net harmless for any damages that may result therefrom. If you have any further questions on this issue, please refer to the Terms of Service. Airconcierge.net expressly disclaims any liability that may arise should any other individuals obtain the information you submit to this website.

With whom does Airconcierge.net share information?

When you submit information to Airconcierge.net, it is collected, processed and maintained solely by us or by third party agents who are bound by privacy restrictions at least as restrictive as those set forth in this policy. We may allow our business partners to collect information about Users that is not extremely sensitive Information. If you would like to opt out from the onward transfer of your information to our non-agent partners, you may send us an email at opt-out-partners@airconcierge.net. Include the word "privacy" in the subject line of the email and all your registration information in the body of the email.

Some Airconcierge.net content is "sponsored by" or "presented by" other companies. Airconcierge.net shares market research data (how the sponsorship performed, names of contest winners, etc.) collected on this website or via email surveys with these partners. This information is aggregate and not linked to specific users.

Partners may sponsor promotions, contests and sweepstakes that require you to reveal details such as your name, address or phone number. Always check their privacy policy before revealing information about yourself. If you don't want these sponsors to have your personal information, you can choose to not participate.

Airconcierge.net reserves the right to disclose Personal Information from both private and public areas of this website at our discretion, if required by law or if we are given reason to believe, in our sole discretion, that someone is causing injury to or interference with the rights of Users, the general public, or Airconcierge.net, to comply with a judicial proceeding, court order or legal process.

We will not transfer to a non-Agent third party any Personal Information that is sensitive in nature, such as information specifying your medical or health condition, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership without your prior affirmative consent.

Finally, Airconcierge.net reserves the right to transfer, sell and/or distribute all information collected through the Service to an affiliate, subsidiary, or third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or part of our business, assets or stock. We will use our best efforts to ensure that the new entity follows this Privacy Policy with respect to your Personal Information, as and to the extent required by applicable law.

How can Users edit their information?

Airconcierge.net believes strongly in giving you the ability to access and edit your personal information. To update your personal info, click My Account at the top of any page. There you can view, update and correct your account information. You may edit your account information at any time -- all you need is your username and password.

So that we can protect the integrity of sensitive data, there are certain pieces of information, such as your age, that you cannot alter yourself. For example, since children under 18 are not allowed to register as Users, we need to take reasonable measures to preserve the accuracy of our Users' ages. Please contact us at info@airconcierge.net to find out how to change information you cannot access through your account.

Our databases automatically update any Personal Information you edit in your profile, or that you request we edit. Information transmitted through boards, chats, polls or through any other means remains in our databases and becomes the property of Airconcierge.net upon submission.

Notification of changes

Airconcierge.net's security and privacy policy are periodically reviewed and enhanced as necessary. This policy might change as Airconcierge.net updates and expands the Service. Airconcierge.net will endeavor to notify you of these changes by email, but will not be liable for any failure to do so. Airconcierge.net also encourages you to review this privacy policy periodically.
